Description
My 'fanart' of KOS-MOS from Xenosaga, created by Namco.I've been working on this (off-and-on) for several weeks now. KOS-MOS was painted freehand in Photoshop with a Wacom Intuos2. All the text stuff was also done in Photoshop. I used Poser to make a reference for the figure, but this image does -not- contain any 3d modeling/rendering of any sort.

On that note, I think the artist should at least give some credit where it's due. It's not your original character, and you should say where you got the character from so that if people are interested, they can see the original and visit the game's website. I find it silly that you would attempt to copyright such a thing which is already copyrighted. Obviously you own the art and a few design elements, but the character design is far from your own.

I generally add copyright notices in case my images travel around the internet without my knowledge... I guess I should state where she came from on the image itself, too. Thank you for your comment, I'm glad someone recognizes the other details from the game that I've included.

As far as making a derivative of copyrighted material, there is a specific bit of law that allows for using copyrighted material in original works. I don't know the actual law itself, but if you look at http://www.utsystem.edu/ogc/intellectualproperty/copypol2.htm
you can read it for yourself and decide. Although I think a piece of artwork such as this (not being sold or reproduced for profit) won't hurt.
If that's a little too hard to understand, there is also Brian, the owner of www.nuklearpower.com who had somewhat the same problem and wrote an essay concerning the matter. http://www.nuklearpower.com/webcomics.php is where you can find it.
